Terms of service
Bulvonia operates under two models. The model depends on the payment method you choose.
Cash on delivery (Poland only) → Model A: sale from a warehouse in Poland
- The seller is DTC Factory sp. z o.o.
- Shipped from a warehouse in Poland, usually within 1–3 business days.
- Receipt or invoice for the goods.
Online payment (card, BLIK, Klarna, PayPal and others) → Model B: intermediation in purchasing from abroad
- DTC Factory sp. z o.o. provides an intermediation service: on your behalf, it orders and pays for the goods from a Foreign Seller (mainly in China and Hong Kong).
- The goods are shipped directly by the Foreign Seller, usually within 14–30 business days.
- You are the importer of the goods. Customs charges may apply if the shipment value exceeds EUR 150.
- Our invoice or receipt covers only the Commission for the intermediation service.
Under both models, you keep your full consumer rights: 14 days to withdraw from the contract, liability for the conformity of the goods with the contract, a 30-day satisfaction guarantee and the right to bring proceedings before the court for your place of residence. See below for details: §6 (Model A) and §7 (Model B).
§1. General provisions
- The online shop Bulvonia, available at bulvonia.com (the "Shop"), is operated by DTC Factory spółka z ograniczoną odpowiedzialnością, with its registered office in Tajęcina, Tajęcina 51E, 36-002 Jasionka, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0001256088, NIP 5170473800, REGON 545311784, e-mail address: halo@bulvonia.com ("Bulvonia"; in Model A also the "Seller", in Model B the "Intermediary").
- The Shop operates under two separate legal models:
- Model A — direct sale from Poland. This applies to orders delivered within Poland and paid for on delivery. Bulvonia is the Seller of the goods, and the goods are shipped from a warehouse in Poland.
- Model B — intermediation in purchasing from abroad. This applies to all orders paid online (payment card, BLIK, Klarna, PayPal, Apple Pay, Google Pay, Shop Pay, bank transfer and other online payment methods available at checkout), regardless of the country of delivery. Bulvonia provides a commercial intermediation service: on the Customer's behalf, it enters into a sales contract with the Foreign Seller and pays for the goods, which the Foreign Seller ships directly to the Customer.
- The Customer chooses the model by choosing the payment method. Information about the models is provided in these Terms and Conditions, the Shipping Policy and the Returns Policy, which are available at all times in the Shop footer and at checkout.
- These Terms and Conditions are made available free of charge in a form that allows them to be downloaded, saved and reproduced. To place an order, the Customer must read and accept these Terms and Conditions.
- The Shop operates in accordance with Polish and EU law, in particular the Polish Act of 30 May 2014 on Consumer Rights, the Polish Civil Code (including the provisions on powers of attorney, Articles 95–109 of the Civil Code, and on mandate contracts, Articles 734–751 of the Civil Code), the Polish Act of 18 July 2002 on the Provision of Electronic Services, the Polish Act on Goods and Services Tax, the Polish Act of 9 May 2014 on Informing about the Prices of Goods and Services, Regulation (EU) 2023/988 on general product safety (GPSR) and Regulation (EU) 2016/679 (GDPR).
§2. Definitions
- Customer — a natural person, legal person or organisational unit that places an order in the Shop.
- Consumer — a natural person who performs a legal transaction that is not directly related to their business or professional activity.
- Sole Trader with Consumer Rights — a natural person who concludes a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for that person. The provisions concerning Consumers apply to a Sole Trader with Consumer Rights with regard to withdrawal from the contract, unfair contract terms and conformity of the goods with the contract.
- Model A — a contract for the sale of goods concluded between Bulvonia (the Seller) and the Customer, with shipment from a warehouse in Poland and payment on delivery.
- Model B — a contract for the provision of an intermediation service concluded between Bulvonia (the Intermediary) and the Customer. It covers concluding a sales contract with the Foreign Seller on the Customer's behalf, paying the price on the Customer's behalf, passing on the delivery details and handling the order, returns and complaints.
- Foreign Seller — a business established outside the European Union (most often in the People's Republic of China or Hong Kong) that owns the goods, sells them to the Customer and ships them directly to the Customer.
- Commission — the flat-rate fee paid to Bulvonia for the intermediation service in Model B.
- Total Price — in Model B, the total amount paid by the Customer when placing the order. It covers the funds for purchasing the goods and their delivery from the Foreign Seller, plus the Commission.
- Power of Attorney — in Model B, the authorisation granted by the Customer to Bulvonia to conclude a sales contract with the Foreign Seller and pay the price on the Customer's behalf (see Annex C for the text).
- Agreement — in Model A, the sales contract; in Model B, the contract for the provision of the intermediation service.
- Business Days — Monday to Friday, excluding public holidays in Poland.
§3. Electronic services and technical requirements
- Through the Shop, Bulvonia allows users, free of charge, to browse the offer, place orders, make contact via the form, chat and e-mail, and subscribe to the newsletter. The contract for these services is concluded for the period during which they are used and expires when an order is placed or the user stops using the Shop.
- To use the Shop, you need a device with Internet access, an up-to-date browser with JavaScript and cookies enabled, and an active e-mail address.
- The Customer must use the Shop in accordance with the law and good practice, provide true information and not submit any unlawful content.
- Complaints about how the Shop works can be sent to halo@bulvonia.com. We respond within 14 days.
§4. The two models — what changes
- Model A: payment on delivery, only for delivery within Poland.
- Model B: any online payment, for delivery to Poland and to the other countries served by the Shop. Outside Poland, only Model B is available.
- The model determines, in particular, who the party to the sales contract is, where the shipment comes from and how long it takes, what the receipt or invoice covers, who is liable for the conformity of the goods with the contract and who the importer of the goods is.
- Under both models, Consumers and Sole Traders with Consumer Rights keep all rights arising from mandatory provisions of law, including the right to withdraw from the contract within 14 days (§9). A Consumer living outside Poland also keeps the protection granted by the mandatory provisions of the law of their country of residence.
§5. Placing orders and concluding the contract
- Orders can be placed 24 hours a day through the Shop website and the product pages, which lead to the Shop checkout.
- The Customer selects the product and the package, enters the delivery details, chooses the delivery method and the payment method, and then confirms the order using a button indicating an obligation to pay.
- By confirming an order paid online, the Customer confirms that they understand the differences between the models described in §4 and grants Bulvonia the Power of Attorney as set out in Annex C.
- After placing the order, the Customer receives an e-mail confirming that it has been received. The Agreement is concluded when this confirmation is sent to the Customer.
- Bulvonia may refuse to fulfil an order or may cancel it, in particular if the goods are permanently unavailable from the Foreign Seller or in the warehouse, the goods are withdrawn for safety reasons, payment is not made, there is an obvious error in the price or description of the offer, the goods may not be imported into the country of delivery, or there is a documented suspicion of abuse (§18). In such a case, Bulvonia will promptly refund all payments received from the Customer.
§6. Model A — sale from a warehouse in Poland (cash on delivery)
6.1. Legal nature
- In Model A, Bulvonia is the Seller of the goods. The parties to the sales contract are Bulvonia and the Customer.
- The goods are shipped from a warehouse in Poland.
6.2. Prices and documents
- Prices are gross prices in Polish zloty (PLN) and include VAT. A cash-on-delivery surcharge is added to the price and is shown at checkout before the order is placed.
- When a price is reduced, Bulvonia also shows the lowest price of the goods in the 30 days before the reduction, in accordance with Article 4a of the Polish Act on Informing about the Prices of Goods and Services.
- Bulvonia issues a receipt or, on request, a VAT invoice for the full value of the order.
6.3. Delivery
- Delivery is carried out by the courier InPost. Orders are usually dispatched within 1 business day and delivered within 1–3 business days of the conclusion of the Agreement. During peak periods, delivery may take up to 5 business days.
- The risk of accidental loss of or damage to the goods passes to the Consumer or Sole Trader with Consumer Rights when the goods are handed over to them.
6.4. Returns and complaints
- Withdrawal from the Agreement: see §9. Returned goods should be sent to: FenXU, Room 218, 3rd Floor, Building B, Deshi Innovation Workshop, No.388 Jinyuan Sixth Road, Jiangqiao Town, Jiading District, 200137 Shanghai, China, tel. +86 15137912080.
- Bulvonia is liable to Consumers and Sole Traders with Consumer Rights for the conformity of the goods with the contract under the Polish Act on Consumer Rights (see §10).
§7. Model B — intermediation in purchasing from abroad (online payment)
7.1. Legal nature
- In Model B, Bulvonia is not the seller of the goods. Bulvonia provides the Customer with a commercial intermediation service: it orders the goods from the Foreign Seller in the name and on behalf of the Customer, pays for them with the Customer's funds and arranges for them to be delivered directly to the Customer.
- The parties to the sales contract for the goods are the Foreign Seller and the Customer. Ownership of the goods passes to the Customer when Bulvonia, acting as the Customer's attorney, makes the purchase.
- In Model B, Bulvonia does not store, pack or dispatch goods. Shipping is handled by the Foreign Seller and its carriers.
7.2. Power of Attorney
- By confirming an order paid online, the Customer grants Bulvonia the Power of Attorney as set out in Annex C.
- The Power of Attorney applies only to the order concerned and expires when the order has been fully completed or when the Customer withdraws from the Agreement.
7.3. Total Price, Commission and documents
- The price shown next to the product and at checkout is the gross Total Price in the currency chosen by the Customer. It covers the funds for purchasing the goods and their delivery from the Foreign Seller, plus the Commission. Any delivery charge is shown at checkout before the order is placed.
- The Customer pays a single amount, the Total Price. Acting as the Customer's attorney, Bulvonia pays the Foreign Seller the price of the goods and delivery. Bulvonia keeps the Commission as its fee for the service.
- Bulvonia issues the Customer a receipt or invoice for the amount of the Commission only. The purchase document for the goods is issued by the Foreign Seller under the rules that apply to it. On the Customer's request, Bulvonia will help obtain this document.
- When a price is reduced, Bulvonia also shows the lowest Total Price in the 30 days before the reduction.
- The Total Price includes all taxes due under the law. If, as a result of a change in the law or its interpretation, Bulvonia is required to account for VAT on all or part of the transaction, that tax is covered by the Total Price already paid and will not be charged to the Customer in addition.
7.4. Import VAT and customs duty
- Shipments worth up to EUR 150 may be covered by the IOSS scheme. If the Foreign Seller uses this scheme, the Foreign Seller accounts for import VAT and it is not collected from the Customer on delivery. Bulvonia is not registered for IOSS. If the Foreign Seller has not used IOSS, the carrier or customs office may collect import VAT from the Customer.
- Shipments worth more than EUR 150 are subject to full customs clearance. In that case, the Customer, as the importer, pays customs duty according to the EU customs tariff, import VAT and any carrier or customs agency fees.
- If the Customer refuses to accept a shipment because of customs or tax charges, Bulvonia may deduct the documented costs of returning the shipment to the Foreign Seller or disposing of it, up to a total of 30% of the Commission, and will refund the remaining amount to the Customer.
7.5. Delivery
- Delivery is carried out by the Foreign Seller through international carriers and couriers in the Customer's country chosen by the Foreign Seller.
- The typical total delivery time is 14–30 business days (order picking and dispatch: 1–7 days; international transport: 10–25 days; customs clearance: 1–5 days; delivery: 1–3 days). During peak periods or transport disruptions, delivery may take up to 45 days.
- The risk of accidental loss of or damage to the goods passes to the Consumer or Sole Trader with Consumer Rights when the goods are handed over to them.
7.6. Satisfaction guarantee
- Regardless of the Foreign Seller's liability, Bulvonia gives the Customer a voluntary satisfaction guarantee for 30 days from delivery of the goods, under the terms of the Returns Policy.
- Under the satisfaction guarantee, the Customer may request a refund, a replacement or a price reduction, including when the goods do not match their description or are damaged or incomplete. Bulvonia handles such requests within 14 days.
- The satisfaction guarantee does not limit the Customer's statutory rights, including the Customer's rights against the Foreign Seller.
§8. Order fulfilment
- After the Agreement is concluded, Bulvonia ships the goods from the warehouse (Model A) or places the order with the Foreign Seller and gives it the delivery details (Model B).
- Once the shipment has been dispatched, the Customer receives an e-mail with the tracking number. In Model B, the tracking number may appear 1–7 business days after the order is placed.
- If the shipment is visibly damaged, it is advisable to complete a damage report with the courier. Not having a damage report does not take away the complaint rights of a Consumer or Sole Trader with Consumer Rights.
§9. Right of withdrawal (14 days)
- Consumers and Sole Traders with Consumer Rights may withdraw from the Agreement without giving any reason within 14 days:
- in Model A, from the day they take possession of the goods,
- in Model B, from the day the intermediation contract is concluded (for the service) and from the day they take possession of the goods (for the sales contract with the Foreign Seller). In practice, if you withdraw after receiving the shipment, the 14 days are counted from delivery.
- To withdraw, you only need to send a statement in any form before the deadline, for example by e-mail to halo@bulvonia.com. You may also use the model form in Annex A.
- Regardless of the model, the goods must be sent back within 14 days of submitting the statement to: FenXU, Room 218, 3rd Floor, Building B, Deshi Innovation Workshop, No.388 Jinyuan Sixth Road, Jiangqiao Town, Jiading District, 200137 Shanghai, China, tel. +86 15137912080. The Customer pays the direct cost of returning the goods according to the carrier's rates.
- Bulvonia refunds all payments received, including the cost of the cheapest delivery method offered, within 14 days of receiving the statement, using the same payment method, unless the Customer expressly agrees to another method that costs them nothing. The cash-on-delivery surcharge in Model A is a cost of the payment method chosen by the Customer and is not refundable. Bulvonia may withhold the refund until it has received the goods or proof that they have been sent back.
- In Model B, if Bulvonia has already paid the funds to the Foreign Seller when it receives the statement, it will refund the Commission and any funds not yet paid within 14 days, and the funds already paid no later than 30 days after receiving the statement. This does not change the obligation to refund the full amount.
- The Customer is liable for any reduction in the value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
- The right of withdrawal does not apply in the cases listed in Article 38 of the Polish Act on Consumer Rights, in particular to goods supplied in sealed packaging that cannot be returned after opening for health protection or hygiene reasons, and to digital content (e.g. e-books) supplied with the Consumer's consent before the withdrawal period expires.
§10. Complaints — conformity of the goods with the contract
10.1. Model A
- As the Seller, Bulvonia is liable to Consumers and Sole Traders with Consumer Rights for any lack of conformity of the goods with the contract that exists at the time of delivery and becomes apparent within 2 years of delivery. The Customer may request repair or replacement and, in the cases specified by law, a price reduction or withdrawal from the contract.
- For Customers who are neither Consumers nor Sole Traders with Consumer Rights, liability under the statutory warranty is excluded to the extent permitted by law.
10.2. Model B
- The Foreign Seller, as the party to the sales contract, is liable for the conformity of the goods with the contract. Bulvonia helps the Customer pursue these claims: it accepts the complaint, corresponds with the Foreign Seller and, on request, provides the Foreign Seller's details (§11).
- In addition, the Customer is entitled to the Bulvonia satisfaction guarantee (§7.6).
- Bulvonia is liable to the Customer for properly performing the intermediation service. This includes placing the order correctly and on time, passing the delivery details and funds to the Foreign Seller, providing the tracking number and handling complaints and returns.
10.3. How to make a complaint
- Complaints can be sent by e-mail to halo@bulvonia.com or in writing to: DTC Factory sp. z o.o., Tajęcina 51E, 36-002 Jasionka, Poland.
- It is helpful to include your full name, contact details, order number, a description of the problem, your request and photos (see Annex B for a model form).
- Bulvonia responds within 14 days. If a Consumer or Sole Trader with Consumer Rights receives no response within this period, the complaint is deemed accepted. If a complaint is accepted, Bulvonia pays the cost of return shipping.
§11. Importer obligations and information about the Foreign Seller (Model B)
- In Model B, the Customer is the importer of the goods within the meaning of EU customs law and is responsible for import charges as set out in §7.4.
- The Customer must provide true and up-to-date delivery and contact details, which are needed for delivery and customs clearance.
- On the Customer's request, Bulvonia will provide the name of the Foreign Seller, the Foreign Seller's order number and the tracking number within 7 business days.
§12. Product safety (GPSR)
- In Model A, Bulvonia acts as the distributor of the goods. In Model B, it acts as an intermediary making the offer of goods available on the European Union market.
- Bulvonia monitors alerts in the Safety Gate system. If a risk is identified, it promptly informs Customers, suspends sales, cooperates with market surveillance authorities and offers a replacement, repair or refund.
- Instructions and safety information are provided in the Customer's language together with the goods or in electronic form. Where required for a given product, Bulvonia provides the details of the person responsible in the EU on the product page, with the shipment or on request.
§13. Liability and force majeure
- For Customers who are neither Consumers nor Sole Traders with Consumer Rights, the liability of Bulvonia is limited to actual loss: in Model A, up to the value of the order, and in Model B, up to the amount of the Commission for the order concerned.
- Bulvonia is not liable for failure to perform or delay in performing the Agreement caused by force majeure, in particular natural disasters, epidemics, war, strikes, decisions of public and customs authorities, border closures and carrier breakdowns.
- The limitations in paragraphs 1 and 2 do not apply to personal injury, damage caused intentionally or through gross negligence, or the rights of Consumers and Sole Traders with Consumer Rights arising from mandatory provisions of law.
§14. Intellectual property
The Shop content, including texts, photos, graphics, logos and trademarks, is protected by law. Copying or using it without the rights holder's consent is prohibited.
§15. Personal data
- The controller of the Customer's personal data is DTC Factory sp. z o.o. (details in §1). The rules for processing personal data are described in the Privacy Policy.
- In Model B, the data needed for delivery (first name, last name, delivery address, telephone number and e-mail address) is transferred to the Foreign Seller. The Foreign Seller may be established in a country outside the European Economic Area, including a country for which the European Commission has not issued an adequacy decision (e.g. China). The legal basis for the transfer is that it is necessary for the performance of a contract concluded at the Customer's request (Article 49(1)(b) GDPR).
§16. Out-of-court dispute resolution
- Consumers may seek assistance from a municipal or district consumer ombudsman, use mediation at a regional inspectorate of the Inspekcja Handlowa (Trade Inspection), or go to a permanent consumer arbitration court. A list of authorised bodies is kept by UOKiK (Office of Competition and Consumer Protection): polubowne.uokik.gov.pl. Consumers from another EU country may contact their national European Consumer Centre.
- The European ODR platform was discontinued on 20 July 2025 under Regulation (EU) 2024/3228.
§17. Final provisions
- The Agreements are governed by Polish law. This does not deprive Consumers of the protection granted to them by the mandatory provisions of the law of their country of habitual residence.
- Disputes with Consumers and Sole Traders with Consumer Rights are resolved by the court with jurisdiction under the general rules. Consumers may bring proceedings before the court for their place of residence. Disputes with other Customers are resolved by the court with jurisdiction over the registered office of Bulvonia.
- Bulvonia may amend these Terms and Conditions for important reasons, in particular changes in the law, the scope of services, payment or delivery methods, decisions of authorities or court rulings. Amendments do not apply to contracts concluded before they come into force.
- The Polish version of these Terms and Conditions is the binding version. Versions in other languages are for information only, subject to paragraph 1.
- The Shipping Policy, Returns Policy and Privacy Policy form an integral part of these Terms and Conditions. If there is any conflict, these Terms and Conditions prevail.
§18. Orders placed in bad faith
Bulvonia may refuse to fulfil an order, suspend it pending clarification or refuse to accept further orders if objective evidence shows that the order was placed using false details, for the purpose of fraud or to disrupt the Shop (e.g. testing payment cards, serial orders to false addresses), or in the event of a serious breach of these Terms and Conditions. This does not limit the statutory rights of Consumers and Sole Traders with Consumer Rights.
